Estimoto Terms of Service

These terms govern access to Estimoto’s mobile app, website, dashboard, and estimating and shop-workflow services (the “Services”).

1. Agreement and authority

By creating an account, accepting an invitation, purchasing a plan, or using the Services, you agree to these terms. If you use Estimoto for a business or other organization, you represent that you have authority to accept these terms for that organization. You must be at least 18 years old and legally able to enter into this agreement.

2. The Services

Estimoto provides software for vehicle-damage documentation, estimate preparation, workflow management, reporting, connected-service automation, and related shop operations. Features may change as the product improves.

3. Accounts and workspaces

Provide accurate account information and keep it current. Protect credentials, devices, and account-recovery methods. Use only the workspace and records you are authorized to access. Workspace owners and managers are responsible for member invitations, permissions, and lawful administration of their workspace.

4. Customer and repair data

You retain ownership of information, photos, files, and other content submitted to the Services (“Customer Content”). You represent that you have all permissions and lawful bases needed to collect, use, upload, and instruct us to process Customer Content. You grant Estimoto a limited, non-exclusive license to host, copy, process, transmit, display, and create technical derivatives of Customer Content only to provide, secure, support, and improve the Services as described in the Privacy Policy.

5. Professional review is required

Estimoto accelerates estimating but does not replace the judgment of a qualified estimator, technician, repair facility, insurer, engineer, or legal or safety professional. You are responsible for inspecting the vehicle, reviewing and editing every output, obtaining customer authorization, following OEM procedures, and complying with insurer, licensing, recordkeeping, tax, and other requirements.

6. Acceptable use

You may not use the Services unlawfully, fraudulently, or deceptively; access another workspace or system without authorization; upload malware or disrupt the Services; reverse engineer or resell the Services; or use automated outputs without meaningful professional review when they could affect a repair, claim, payment, or safety decision.

7. Third-party services

Optional integrations and external services, including identity, email, cloud storage, payment, vehicle-data, shipment-tracking, SMS delivery, and AI providers, may be governed by their own terms and privacy policies. You authorize us to exchange the information needed to provide an integration you enable.

8. SMS / text messaging terms

Shops using Estimoto may offer a text messaging program that sends transactional and customer-care messages, including estimate links, approval requests, repair status updates, pickup notifications, appointment reminders, and replies to questions, to customers who have opted in. By opting in, you agree to receive these messages at the mobile number you provided.

Mobile information and messaging consent are handled as described in the SMS section of our Privacy Policy: they are never shared with third parties or affiliates for marketing or promotional purposes.

9. Plans, fees, and billing

Paid use is governed by the plan, usage tiers, billing interval, and price displayed at checkout or in an order form. Taxes may apply. Unless an order form says otherwise, subscriptions renew automatically until canceled through the web billing portal. Purchases are handled on the web and not through Apple in-app purchase.

10. Estimoto property and feedback

Estimoto and its licensors own the Services, software, designs, documentation, models, and related intellectual property, excluding Customer Content. Subject to these terms and payment of applicable fees, Estimoto grants you a limited, revocable, non-exclusive, non-transferable right to use the Services for your internal business operations.

11. Suspension, termination, and deletion

You may stop using Estimoto at any time and may delete your user account from the app. We may suspend or terminate access for nonpayment, material breach, security risk, unlawful use, or conduct that threatens the Services or others.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ESTIMOTO DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESTIMOTO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. ESTIMOTO’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID ESTIMOTO FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnity

To the extent permitted by law, a business using Estimoto will defend and indemnify Estimoto from third-party claims arising from that business’s Customer Content, unlawful use of the Services, violation of these terms, or repair and claim decisions made from unreviewed or improperly used outputs.

15. General terms and contact

These terms, the Privacy Policy, and any applicable order form are the entire agreement about the Services. We may update these terms; we will post the revised version and update the effective date. Questions may be sent to hello@estimoto.io.
